The Private Attorney General Act (“PAGA”) seeks to enforce various statutory workplace violations on behalf of both, the State of California and his coworkers. The employee, who has been wronged, is typical of a company wide policy committing illegal acts to all employees similarly situated. The individual, through PAGA, can become a true champion of this cause, and hero of the public interest; benefiting the general public and not just himself and his coworkers. The PAGA seeks to put a halt to the illegal misconduct and enforce monetary penalties on behalf of the state, thus allowing the private sector to free up the human and financial resources of the public enforcement agencies, including the Labor and Workforce Development Agency. This is a wonderful statute that not only costs the taxpayers essentially nothing, but seeks to collect revenue though the efforts of the private lawyer hired by the employee on a contingency, no recovery no fee basis.
